Dear WorkPac Construction Employee

This page is dedicated to providing information in relation to the renegotiation of the WorkPac Construction (Victoria – Major Works) Agreement.

The existing agreement has reached its nominal expiry date, however continues to operate until we actively replace it.

Here we seek to provide you with everything you need in order to make an informed decision on the proposed agreement.

What is an enterprise agreement?

An enterprise agreement is an agreement between an employer and its employees that will be covered by the agreement that sets the wages and conditions of those employees for a period of up to 4 years. To come into operation, the agreement must be supported by a majority of the employees who cast a vote to approve the agreement and it must be approved by an independent authority, Fair Work Australia who perform a test on the Agreement to make sure that employees are better off overall under the Agreement than under the Award.

Employees Who Would Like to be Covered by the Proposed Agreement

You have the right to appoint a bargaining representative to represent you in bargaining for the agreement or in a matter before Fair Work Australia about bargaining for the agreement.

You can do this by notifying any person in writing that you appoint that person as your bargaining representative. You can also appoint yourself as a bargaining representative. In either case you must give a copy of the appointment to your employer.

If you are a member of a union that is entitled to represent your industrial interests in relation to the work to be performed under the agreement, your union will be your bargaining representative for the agreement unless you appoint another person as your representative or you revoke the union’s status as your representative. If this applies, you will need to provide proof of current union membership to your employer.

Who will be covered by this Agreement?

This Agreement applies in the State of Victoria to all WorkPac FTMs engaged in Civil Construction work as defined by the Building and Construction General On Site Award 2010 for projects over $2.5 million.

 

Who are the parties to this Agreement?

WorkPac;
WorkPac Employees who can be covered by the Agreement; and
Australian Workers Union.

 

How long will the Agreement operate?

31 October 2014

 

What is my minimum rate of pay?

Your minimum rate of pay can be found in Appendix B of the Agreement, which is located on page 45.

 

What are the hours of work under this Agreement?

The ordinary hours of work are 36 hours per week.

 

What are the wage increases in this Agreement?

12.5% (compounded)
From 1st full pay period commencing on or after 1 March 2012 – 5%
From 1st full pay period commencing on or after 1 March 2013 – 5%
From 1st full pay period commencing on or after 1 March 2014 – 5%

 

What is the value of the travel allowance?

On lodgement of Agreement $32.14 per day
1 March 2012 $33.75 per day
1 March 2013 $35.44 per day
1 March 2014 $37.21 per day

 

What is the casual loading percentage?

25%

 

What is the minimum engagement for a casual FTM?

The minimum engagement is 8 hours, but the casual FTM will be paid for all hours worked

 

Who is entitled to annual leave?

Full time and part time WorkPac employees accrue annual leave. Casual WorkPac employees are not entitled to annual leave.

 

Do I get leave loading?

Base rate FTMs will be paid leave loading when they take their annual leave.

Flat rate FTMs do not get paid leave loading when they go on annual leave. Flat Rate FTMs have had the value of the leave loading included in the calculation for the flat rate of pay.

 

Who is entitled to the redundancy provisions?

Redundancy payments apply to all FTM’s. WorkPac will make pro-rata contributions to a recognised fund on behalf of all Maximum Term FTMs.

 

Who is a shift worker?

The Agreement defines three different types of shifts: day shift (i.e shifts starting on or after 6.00am and before 10.00am), afternoon shift (i.e shift starting between 10.00am and 6.00pm) and night shift (i.e shift starting between 8.00pm and 6.00am). Shiftworker does not include those FTMs who work permanent Day Shift. You do not attract a shift allowance if while working on day shift. If you work permanent afternoon or night shift, or a combination of these shifts, you will be considered a shiftworker and be entitled to a 50% loading on your hourly rate when working either afternoon or night shift.

 

How does the Living Away From Home Allowance apply?

If you are required to live away from your usual place of residence to be able to work, you may be entitled to a Living Away From Home Allowance, or alternatively, the provision of meals and lodging. To be eligible, the location of your assignment must be located outside the Melbourne Metropolitan area, and your usual place of residence (which must be evidenced) must be more than 70 kilometres from the client’s worksite. In these circumstances, and providing you have declared your usual place of residence prior to commencing work, you may be entitled to an allowance per day of work or alternatively, WorkPac will provide you with adequate meals and lodging.

 

Who is entitled to Personal Leave?

FTMs employed as full time FTMs are entitled to 10 days paid personal leave accrued for each 12 month period of employment. Part time FTMs are entitled to pro rata personal leave. Personal leave includes sick leave and carers leave.

Casual FTMs do not accrue personal leave.

 

Who is entitled to Compassionate Leave?

Full time and part time FTMs are entitled to 2 days paid compassionate leave for each time an immediate family member or member of their household dies or is so ill or injured such that it poses a serious threat to their life.

Casual FTMs will be entitled to 2 days of unpaid compassionate leave in the same circumstances.

 

Can I agree to some parts of the Agreement and not others?

No, the terms and conditions of the proposed Agreement are offered as a package.

 

How will the Agreement be approved?

The Agreement will be approved if more than half of the WorkPac employees who are covered by the Agreement vote ‘yes’ in a secret ballot.
